Chapter 9 - The Custody Battle

The next few hours were spent in a windowless hospital conference room, surrounded by lawyers, police detectives, and child protective services.
The fertility clinic's legal team arrived, desperately trying to offer settlements and non-disclosure agreements to make the criminal charges disappear.
I refused every single piece of paper they shoved across the heavy oak table.
Clara sat beside me, clutching a folder containing David's genetic records and her own maternal paperwork.
The state prosecutor made it very clear that Elena would be facing severe federal charges for wire fraud and human trafficking.
Because Clara was the biological mother, the state was prepared to grant her immediate temporary custody once the baby was cleared from the NICU.
However, the legal definition of the birth mother still technically named Elena on the original, unsigned paperwork.
“I want to adopt him,” I said suddenly, surprising everyone in the room, including myself.
Clara turned to me, her eyes wide with shock and confusion.
“He is my nephew biologically, but I have loved him as my son since the moment I saw the first ultrasound,” I explained, looking directly into my sister's eyes.
“I want to co-parent him with you, Clara, if you will let me be a part of his life.”
Tears spilled down Clara's cheeks as she reached across the table and squeezed my hand with incredible strength.

“Of course, Mark,” she whispered, her voice choked with profound emotion.
“He needs a father, and David would have wanted it to be you.”
