Chapter 14 - The Plea Deal

In early November, just three days before jury selection was scheduled to begin in federal district court, Greg’s defense attorney approached the U.S. Attorney’s office with a comprehensive plea offer.
Facing a potential sentence of thirty-five years in a federal penitentiary if convicted by a jury, Greg agreed to plead guilty to three counts of wire fraud and one count of tax evasion.
In exchange for a recommendation of a reduced sentence of fifteen years without parole, Greg agreed to testify against three bank officials who had facilitated his fraudulent offshore loans.
Crucially for my civil litigation, Greg’s signed plea agreement included a full, unredacted confession regarding the forgery of my signature on the corporate equity documents.
He admitted under federal oath that Monica had been fully aware of the embezzlement, acknowledging that she routinely deposited the fraudulent consulting checks into her personal checking accounts.
While the federal prosecutors declined to indict Monica due to her status as a mother of two minor children, the civil implications of Greg’s confession were absolute and devastating for her.
She was now legally classified as a recipient of fraudulent transfers, meaning the bankruptcy court had the authority to seize every piece of jewelry, art, and furniture she had purchased since 2021.
Arthur Pendelton’s corporate recovery lawyers immediately placed liens on Monica’s vehicle and froze her small personal retirement account to satisfy the outstanding corporate debt.
She was left with nothing but her clothes, her children, and a part-time job as a receptionist at a local dental office that paid just above the state minimum wage.
My parents were similarly financially crippled by the fallout, having spent their entire remaining life savings paying federal fines for the shell companies registered at their address.
