Chapter 9 - The Trial Date Set

Six months passed with the steady, relentless progression of the judicial system. While Julian remained incarcerated at the County Metropolitan Detention Center—his multiple appeals for bail denied by three separate appellate judges due to his flight risk and financial resources—my life underwent a profound, beautiful transformation within the safety of my father’s estate.
My left arm had completely healed following the orthopedic surgery, leaving only a thin, neat silver scar along my forearm where the titanium plate had been inserted—a permanent badge of my survival and physical resilience. More importantly, little Leo had flourished. Removed from the constant, suffocating tension and walking-on-eggshells atmosphere of our old house, his childhood anxiety melted away. He was enrolled in a wonderful kindergarten program near my father’s home, playing soccer, laughing loudly, and sleeping through the night without fear of hearing angry shouts down the hallway.
In mid-April, we sat in the executive conference room of the District Attorney’s office for our final pre-trial briefing before jury selection began for The State of New York vs. Julian Montgomery.
ADA Evelyn Thorne sat across from us, surrounded by towering boxes of forensic evidence, financial ledgers, and medical charts. "We are ready," ADA Thorne said, her voice projecting absolute, unshakeable confidence. "The defense attempted to offer a plea bargain yesterday afternoon: a guilty plea to simple domestic battery and financial restructuring in exchange for a five-year sentence and supervised visitation with Leo."
I felt a brief, instinctive chill at the mention of visitation, but Elena reached over and placed her hand firmly over mine.
"I told them to take their offer and burn it," ADA Thorne continued, a grim smile touching her lips. "We are going to trial on all twenty-four felony counts: First-Degree Aggravated Domestic Assault, Child Endangerment, Federal Wire Fraud, Bank Fraud, and Aggravated Identity Theft. With Eleanor testifying for the prosecution under her proffer agreement, and the forensic computer logs Sarah compiled showing his premeditated financial theft, we aren't just looking for a conviction. We are looking for a consecutive sentence that will put him behind bars for the next twenty-five years."

"We consolidated the family court proceedings with the felony trial docket under the State Victims' Protection Act," Elena explained, sliding a finalized judicial order across the table. "The moment the jury returns a guilty verdict on the felony assault and child endangerment charges, Judge Harrison has agreed to sign an immediate, irrevocable Decree of Parental Termination. Julian will be stripped of all biological, legal, and physical rights to Leo forever. He will become a legal stranger to your son."
I looked out the window of the DA's office at the bright spring sunlight streaming over the city skyline. For years, I had believed I was trapped in a dark, hopeless tunnel with no exit. Now, looking at the formidable team of prosecutors, investigators, and family members standing like an impenetrable wall of steel around my life, I realized that the tunnel was finally over. It was time to step into the courtroom and finish the battle I had started on the hallway tiles.
