Chapter 5 - The Arraignment Hearing

Monday morning arrived with a cold, driving rain that lashed against the high arched windows of the County Superior Courthouse. Courtroom 3B was packed to capacity, not just with standard legal personnel, but with reporters from local financial beats who had caught wind of the sudden arrest of Julian Montgomery—a prominent real estate developer and society regular. I sat in the front row of the gallery, my left arm securely supported in a black medical sling, flanked by my father on one side and two of Elena’s junior associates on the other.
When the bailiff called the docket for The State of New York vs. Julian Montgomery, the side door of the holding cells clanged open. Julian shuffled into the courtroom, handcuffed and wearing a bright orange county jail jumpsuit that clashed violently with his aristocratic ego. His face was unshaven, his eyes dark with exhaustion and suppressed rage. As he sat down at the defense table next to his high-priced criminal attorney, Arthur Harrison, his eyes scanned the gallery, locking onto me with a venomous glare before my father shifted his broad shoulders, completely blocking Julian’s line of sight.
"Your Honor," Attorney Harrison began smoothly, standing before the judge as soon as the charges were read. "My client is a respected business leader with no prior criminal record. What occurred on Saturday evening was an unfortunate, isolated domestic misunderstanding that escalated during a moment of high emotional stress. Mr. Montgomery is not a flight risk, nor does he pose an ongoing danger to the community. We request reasonable bail set at fifty thousand dollars, with standard electronic monitoring."
The Assistant District Attorney, a no-nonsense woman named Evelyn Thorne whom Elena had briefed an hour before the hearing, stood up instantly, waving a thick blue legal binder.
"Your Honor, the State strongly opposes bail in any amount," ADA Thorne stated clearly, her voice projecting through the courtroom. "This was not an 'isolated misunderstanding.' The defendant committed a brutal, unprovoked physical assault resulting in a transverse radial fracture and facial lacerations, executed directly in front of a five-year-old child."
ADA Thorne tapped her tablet, transmitting a document directly to the judge's monitor. "Furthermore, Your Honor, since the defendant's arrest forty-eight hours ago, our office has received an extensive forensic financial dossier compiled by the victim and verified by federal financial investigators. The defendant is currently under active investigation for multi-million-dollar wire fraud, identity theft, and the illicit offshore concealment of marital assets. He possesses liquid resources in non-extradition jurisdictions and has demonstrated a willingness to use extreme violence to prevent the disclosure of these financial crimes. If released, he poses an immediate, catastrophic flight risk and a severe threat to the victim's life."
Judge Harrison’s brow furrowed as he read through the preliminary fraud summary on his screen. He looked down over his glasses at Julian, who was whispering frantically into his attorney’s ear, his face turning a deep, panicked red.
"Mr. Harrison," the judge addressed the defense counsel, his voice dripping with judicial skepticism. "Your client is facing serious violent felony charges, compounded by what appears to be a sophisticated, multi-jurisdictional financial fraud scheme. A business leader he may be, but the court cannot ignore the severe physical trauma inflicted upon his spouse or the substantial offshore assets available to facilitate evasion of justice."

The judge struck his gavel down onto the sounding block with absolute finality. "Bail is denied. The defendant is remanded to the custody of the County Metropolitan Detention Center pending trial. I am also issuing a comprehensive, lifetime permanent Protective Order: Mr. Montgomery is barred from any physical, verbal, or digital contact with Sarah Vance or the minor child, Leo Montgomery. Violation will result in immediate summary contempt. Remove the prisoner!"
As the bailiffs grabbed Julian’s arms to lead him away, he lost his composure entirely. "Sarah! You can't do this! You took my son! You took everything!" he screamed across the courtroom before the heavy steel doors slammed shut behind him, cutting off his desperate cries and leaving his mother, Eleanor, sitting alone in the third row, weeping into her designer handkerchief.
