Chapter 10 - The Deposition of Truth

By October, Julian and Victoria’s marriage had degenerated into a toxic, venomous war zone of mutual recrimination and financial panic. Stranded in a mid-tier suburban rental apartment with dwindling savings and zero corporate income, Victoria did what entitled socialites always do when the ship begins to sink: she filed for an at-fault divorce and an emergency spousal support order against Julian, claiming he had misrepresented his financial liquidity prior to the marriage.

To defend himself against Victoria’s claims that he had hidden marital assets, Julian’s cheap divorce attorney subpoenaed me and Clara to appear for a formal financial deposition at a downtown court-reporting office, intending to prove that I was illegally withholding trust funds that rightfully belonged to the marital estate.

We walked into the conference room on a cool autumn morning accompanied by Elena Rostova, my primary family and civil litigation attorney—a woman known in Boston legal circles as "The Ice queen" for her relentless, surgical courtroom dismantling of abusive spouses.

Julian sat across the long mahogany table alongside his stressed-looking lawyer. He looked older, his face puffy from stress and alcohol, glaring at us with bloodshot eyes. Victoria sat at the far end of the table with her own team of aggressive Vale Industries corporate lawyers, maintaining a haughty, contemptuous distance from her husband.

"Mr. Thornton," Julian’s attorney began, starting the digital recording machine. "We are here today to establish the legal ownership structure of The Thornton Family Living Trust. Isn't it true that upon his twenty-first birthday, your son Julian was granted a vested fifty-percent beneficial interest in the capital assets of said trust?"

"He was granted conditional beneficiary status subject to the governing bylaws of the trust," I replied smoothly, leaning back in my chair without looking at Julian.

"And isn't it true that on July 28th of this year—without prior written notice or fiduciary consultation—you unilaterally revoked his beneficiary status and froze over four million dollars in capital assets that were utilized to support his marital household?"

"I executed a lawful administrative revocation pursuant to Article 14, Section B of the trust agreement," I stated.

Julian’s lawyer smiled smugly, believing he had caught me in a legal contradiction. "Article 14? The clause regarding 'gross moral turpitude and financial malfeasance'? Mr. Thornton, my client has never been convicted of a crime, nor has he been charged with any financial misconduct by any regulatory agency. On what legal basis do you justify invoking a morality clause to strip a vested heir of his property?"

Elena Rostova didn't wait for me to answer. She reached into her leather briefcase, pulled out a certified USB flash drive, and plugged it directly into the conference room’s audiovisual presentation monitor.

"We justify the revocation on the basis of Exhibit A, Counselor," Elena said, her voice dripping with freezing professional disdain. "Which we are now formally entering into the civil discovery record of this divorce proceeding, as well as submitting to the Suffolk County District Attorney’s Office for criminal evaluation."

She tapped her remote control. The eighty-inch wall monitor flickered to life, displaying the high-definition footage from the Rosewood Country Club corridor.

The entire conference room went dead silent. Victoria’s corporate lawyers sat forward, their jaws dropping open as they watched their client swat the sapphire brooch onto the floor and kick Clara’s shawl. Julian’s attorney turned pale, looking from the screen to Julian with an expression of profound professional horror as he watched his client shove his own mother into a wall.

When the video ended, Elena turned on the lights and looked across the table at Julian’s lawyer.

"Under the laws of the Commonwealth of Massachusetts, assault and battery upon an elderly or vulnerable family member constitutes a felony offense and definitive proof of gross moral turpitude," Elena stated coldly for the court reporter. "Furthermore, my firm has just filed a civil tort lawsuit against both Julian Thornton and Victoria Vale for intentional infliction of emotional distress, elder abuse, and the destruction of heirloom property, demanding two point five million dollars in compensatory and punitive damages."

Elena closed her binder with a sharp, echoing snap. "Your client doesn't have a trust fund, Counselor. He has a criminal defense problem. Are there any further questions for the primary trustee?"

Julian’s lawyer slowly closed his legal pad, shook his head, and whispered the only three words left available to him: "No further questions."
