Chapter 5 - The Legal Reality

Friday afternoon, I sat in the polished conference room of Marcus’s law firm. The heavy oak table was covered in manila folders, financial statements, and breach of contract notices.

"Your father's attorney reached out this morning," Marcus said, adjusting his glasses. "They are threatening to sue you for breach of fiduciary duty and tortious interference."

I let out a dry, humorless laugh. "On what grounds? The guarantor agreement clearly stated I could withdraw my backing with thirty days' notice to the lender, or immediately in the event of default. He defaulted on the lease."

"Exactly," Marcus nodded, a shark-like smile appearing on his face. "It's an empty threat. A scare tactic. They don't have the capital to fund a lawsuit, let alone win one. In fact, reviewing the ledgers, your father has been co-mingling personal and business funds. He used the company credit line to pay for your mother’s country club dues and renovations to their private residence."

My stomach turned. Not with guilt, but with profound disgust. I had worked eighty-hour weeks to build my agency, sacrificing sleep and social events, while my father used my financial backing to play a wealthy tycoon.

"What happens now?" I asked.

"The creditors will liquidate," Marcus said simply. "The warehouse will be foreclosed on. The trucks will be auctioned. Because he co-mingled funds, the corporate veil is pierced. They will go after his personal assets to satisfy the remaining debt. The house, the cars, everything."

A small, terrified part of the little girl inside me—the girl who just wanted her dad to be proud of her—trembled. But the woman who had watched her son get struck over a piece of chocolate ruthlessly crushed that little girl.

"Let them," I said. "Authorize the bank to proceed with whatever aggressive collections they deem necessary."
